The Supreme Court will address on Tuesday the petition seeking to nullify the electoral sabotage raps and the consequent arrest of former President Gloria Macapagal Arroyo.In a press conference, Marquez debunked accusations the high court may decide in favor of Arroyo and allow her to go scot-free. He said he does not want to preempt the decision of the high court. Any decision will go either way, he said.The high court, after careful deliberation, could dismiss the petition if the incidental actions thereafter have mooted it. It can also ask opposing parties for their comments.He said that if a provisional remedy was requested, the high court may, if necessary, issue a status quo ante order. In an urgent petition filed on Monday, former First Gentleman Mike Arroyo asked the high court to declare all the actions of the Joint Department of Justice-Commission on Elections fact finding and preliminary investigation committee as illegal. This includes the subsequent filing of information or charge sheet, which was the basis for last Friday’s issuance of a warrant of arrest against the former President. Judge Jesus Mupas of Pasay RTC branch 112 today approved the temporary hospital arrest of former President Arroyo pending the manifestations of the defense and prosecution. The defense for their part has filed a motion seeking to suspend proceedings. They also objected to the arrest warrant issued by the court and the possible issuance of a HDO. The arrest warrant had been issued earlier in the day, just after the government lost a bid to reverse a Supreme Court ruling allowing Arroyo to travel abroad. Police said Arroyo's family, her lawyers and some members of her cabinet were at her side in the hospital when the warrant was served. A police team expects to take an hour in the booking of former President Gloria Macapagal Arroyo, who was arrested Friday evening on charges of poll fraud. The team arrived Saturday morning at the St. Luke's Medical Center in Taguig City, where Arroyo has been staying since Tuesday night. But the police team said it could not immediately start the booking process as Arroyo was still being examined by her doctors, radio dzBB's Allan Gatus reported. Members of the team include police personnel from the Southern Police District (SPD), Metro Manila police and Criminal Investigation and Detection Group (CIDG). The report quoted Metro Manila CIDG head Senior Superintendent Joel Coronel as saying the team will start the process once Arroyo's doctors give the go-signal. Arroyo has been staying at the SLMC since Tuesday night after she was barred from leaving the country. She was placed under the custody of the SPD after police served the arrest warrant on her at 6:30 p.m. Friday.
